By accessing or using ApexGen ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.

ApexGen is an AI-powered lead reactivation platform that helps businesses:
- Manage and reactivate aged leads
- Automate multi-channel campaigns (Email, SMS, Voice)
- Deploy AI agents for lead engagement
- Track campaign performance and ROI
3. User Accounts
3.1 Account Creation
You must provide accurate, complete, and current information during registration. You are responsible for maintaining the confidentiality of your account credentials.
3.2 Account Responsibilities
- You are responsible for all activities under your account
- You must notify us immediately of any unauthorized access
- You must not share your account credentials
- You must be 18 years or older to use the Service
4. Subscription Plans & Billing
4.1 Plan Types
- Explore Plan: Free view-only access with limited features
- Starter Plan: $197/month - 1,000 leads, 3 AI agents, 10 campaigns
- Pro Plan: $497/month - 5,000 leads, 10 AI agents, 50 campaigns
- Enterprise Plan: Custom pricing - Unlimited access
4.2 Payment Terms
Paid plans are billed monthly in advance. Charges are non-refundable except as required by law.
4.3 Cancellation
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
5. AI Credits & Usage
- Each plan includes a monthly AI credit allowance
- Credits are consumed for AI conversations, message generation, and voice calls
- Unused credits do not roll over to the next month
- Additional credits can be purchased separately
6. Acceptable Use Policy
You agree NOT to use the Service to:
- Send spam or unsolicited messages
- Violate CAN-SPAM Act, GDPR, or other applicable laws
- Harvest or collect email addresses without consent
- Transmit malware, viruses, or harmful code
- Impersonate any person or entity
- Interfere with the Service's operation
- Reverse engineer or attempt to access source code
7. Data & Privacy
Your use of the Service is also governed by our Privacy Policy.
- You retain ownership of your lead data
- We use industry-standard encryption to protect your data
- We do not sell your data to third parties
- You are responsible for obtaining consent to contact your leads
8. Intellectual Property
The Service, including all content, features, and functionality, is owned by ApexGen and protected by copyright, trademark, and other intellectual property laws.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, APEXGEN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.
10. Termination
We reserve the right to suspend or terminate your account at our discretion if you violate these Terms. Upon termination, you will lose access to your data unless you export it beforehand.
11. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance.
12. Governing Law
These Terms are governed by the laws of the United Kingdom. Any disputes will be resolved in UK courts.
